Summary of verbal and written correspondence [PDF] regarding implementation of Court Annexed Mediation at George Magistrates Court, in Case 5048-15: L Johnson v Clive Johnstone; where – temporarily pending the accreditation of local court annexed mediators by the Dept of Justice – the Magistrate could provide his written consent to the Clerk to appoint a local George mediator who is not on the list of Court Annexed Mediation accredited mediators, but has equivalent mediation skills.

On 07 March 2018, Court Manager: Mbomvana Siphumze and Magistrate Ngaliphi Sokhiwo consented to Lara Johnson request to consider the implementation of Court Annexed Mediation at George Magistrates Court.

Magistrate Ngaliphi Sokhiwo took Lara to the Clerk of the Court: Charmaine Lottering, and requested Lara to provide Charmaine with the Government Gazette Court Annexed Mediation Rules and information, for her to read, to enable her to administer the Court Annexed Mediation applications. Lara provided Charmaine with the DoJ Court Annexed Mediation Rules, Fees and Forms information.

On 12 March 2018, Clerk of Court: Charmaine Lottering responded to Lara, refusing to implement Court Annexed Mediation at George Magistrates Court, due to an alleged absence of local available qualified mediators.

On 12 March 2018, Lara informed Charmaine that her 09 March 2018 Filing [PDF] she had requested a ‘court annexed mediation’ hearing with the Civil Court Magistrate Guts Essel, scheduled for 27 March 2018: 14:00 hrs, for the Magistrate to provide his written consent to the Clerk to appoint a local George mediator who is not on the list of Court Annexed Mediation accredited mediators, but has equivalent mediation skills from FAMAC: Family Association of Mediators of the Cape, ADR Network of Accredited Mediators or SAAM: SA Association of Mediators; who is willing to adapt their mediation skills, to provide mediation in accordance to Court Annexed Mediation Rules.

On 12 March 2018, Lara made a written email request to Minister of Justice Mike Masutha , Dir Gen Madonsela, Ms Corlia Kok and DoJ: Court-Annexed Mediation Project Office: Ms Stella Maphoso; to clarify whether they had any objections to the George Civil Court Magistrate conducting the ‘court annexed mediation’ hearing; to provide his written consent to the Clerk to appoint a local George mediator who is not on the list of Court Annexed Mediation accredited mediators, but has equivalent mediation skills from from FAMAC: Family Association of Mediators of the Cape, ADR Network of Accredited Mediators or SAAM: SA Association of Mediators; who is willing to adapt their mediation skills, to provide mediation in accordance to Court Annexed Mediation Rules.

On 27 March 2018, shortly prior to the scheduled ‘court annexed mediation’ hearing; Lara emailed the Minister of Justice Mike Masutha , Dir Gen Madonsela, Ms Corlia Kok and DoJ: Court-Annexed Mediation Project Office: Ms Stella Maphoso; to inform them of her interpretation that their lack of written consent/objection response was interpreted as “The Dept of Justice and/or Court Annexed Mediation Project Office do not currently have any objections to the Magistrate in George Civil Court Case 5048-15: L Johnstone v CH Johnstone; consenting to the ‘appointment of alternative with equivalent mediation skills Court Annexed Mediator’ for mediation resolution of Applicant and Respondents ‘EoP Taaibos TRC et al’ issues of dispute.”

On 27 March 2018, Lara Johnson and Clive and Ann Johnstone arrived at George Magistrates Court for the ‘court annexed mediation’ hearing scheduled for 14:00 hrs. The Civil Court was locked. Lara went up to the Clerk’s office to get the file, where she was informed by Charmaine that Magistrate Essel had refused to conduct the ‘court annexed mediation’ hearing.

On 27 March 2018, Lara Johnson emailed Charmaine, to request her, as Clerk of the Court; to kindly request Magistrate Essel to put his verbal decision – regarding the ‘court annexed mediation’ hearing scheduled for 27 March 2018 at 14:00 hours in Case 5048-15: Lara v Clive Johnstone, consented to in writing, by Lara, Clive and Ann Johnstone – and reasons for his decision in writing.

On 27 March 2018, Lara emailed court manager, Mbomvana Siphumze; to enquire whether there was another civil court magistrate available in George Magistrates Court, who would be willing to conduct the ‘court annexed mediation to consent to applicants and respondents consent and request to order clerk to appoint a mediator with equivalent mediation skills’ hearing; so that the ‘court annexed mediation’ hearing can be postponed to such date.

On 28 March 2018, Court manager, Mbomvana Siphumze; emailed Xhanti Zeka, Gauteng Chairman, JOASA: Judicial Officers Association of South Africa; requesting your intervention in the matter.

Alternative Option to Court Annex Mediation Hearing:

It is unclear whether Magistrate Essel and the Clerk’s objections are a result of not wanting to provide court annexed mediation services; or whether they would be willing to provide court annexed mediation services, subsequent to – for example – (a) JOASA or DoJ Court Annexed Mediation Project Office, hosting a ‘court annexed mediation’ workshop for George Magistrates, clerk, mediators and lawyers; or (b) Ministry of Justice providing them with written authorization to proceed with court annexed mediation services at George Magistrates Court.

There is no provision in the Magistrates Courts Act for any Magistrate to appoint a Court Annexed Mediator,. So no, as already pointed out, the appointment of Court Annexed Mediators has nothing to do with Magistrates.

There is a provision in the Magistrates Courts Act Court Annexed Mediation Rules [86(1)(2)] providing the Minister of Justice with the authority to accredit and manage the accreditation of court annexed mediators.

There is a provision in the Magistrates Courts Act [77(4)(a)] providing the applicant and respondent with the authority to collaborate with the clerk in the appointment of a mediator whom they would both consent to and consider suitable and credible to help them to mediate their issues in dispute.

There is no provision in the Magistrates Courts Act prohibiting the Minister of Justice from consenting to an applicant and respondents request that – temporarily pending the accreditation of local court annexed mediators by the Minister of Justice – the Minister of Justice (a) consenting to the applicant and respondents request to temporarily appoint a local mediator who is not on the list of Court Annexed Mediation accredited mediators, but has equivalent mediation skills; and/or (b)  consenting to the applicant and respondents request to authorize a Magistrate to provide his/her written consent to the Clerk to appoint a local George mediator who is not on the list of Court Annexed Mediation accredited mediators, but has equivalent mediation skills.

If or when a Ministry has been assigned by statute, a particular authority – in this case accreditation and management of accreditation of mediators – it similarly has the authority to – where sufficient justifications exist – consent to such authority being temporarily transferred to a Magistrate or whomever it considers appropriate, in such particular case, to fulfil the required duties and/or tasks, assigned to it by statute.

So, generally speaking, yes, the appointment of Court Annexed Mediators has nothing to do with Magistrates; but in the above mentioned case, the appointment of Court Annexed Mediator – subject to the factors stipulated – does have something to do with the Magistrate.
