Attached is signed Settlement Agreement with Clive and Ann Johnstone, reached by negotiation; filed with High Court Registrar on 02 April 2019 [PDF].

According to Court Annexed Mediation Rules [PDF] paragraph 82 (4) If a settlement is reached at mediation in a dispute which is the subject of litigation, the registrar of the court must at the request of the parties and upon receipt of the settlement agreement from the mediator, place the settlement agreement before a judicial officer in chambers for noting that the dispute has been resolved or to make the agreement an order of court, upon the agreement of the parties.

The Registrar suggested that the Settlement Agreement should be made an order of court, not in chambers, but by requesting that the matter be placed on the court roll, and that the Judge makes the Settlement Agreement an Order of court, during court proceedings, with applicant and respondents present to answer any of the Judge’s questions and/or to confirm their signatures and consent to the settlement agreement.

I consented to her suggestions.

Magistrate Essel was in the Registrar’s office while I was discussing the filing of the Settlement Agreement with the Registrar. I don’t know if he was listening to our conversation but if he was, he did not contradict her suggestions.

Below is the email to Graeme, Hilary, Frode and Talitha informing them of the court filing of the Settlement Agreement.

It includes the Registrar’s suggestions for making the Settlement Agreement an order of court, which I told Pa about when I provided him with your printed copies of the filing.

I also informed Pa, when I gave him your printed copies of the filed Settlement Agreement; that before making the Settlement Agreement an Order of court, by requesting that the matter be placed on the court roll; I will again provide Magistrate Torlage a copy – he was previously provided a copy – to make sure he has no edits and/or objections to the Settlement Agreement Enclosure: Joint Statement by Lara, Clive and Ann Johnstone: Re: Written Summary of Verbal Statements made in 10 May 2016 Negotiations Meeting with Magistrate Torlage.
