Tara Smith: Why the ICC need a silver bullet global treaty against ecocide:
The International Criminal Court is not known for prosecuting people responsible for huge oil slicks, chopping down protected rainforests or contaminating pristine land. But these people may now one day find themselves on trial in The Hague. The move was announced by chief prosecutor Fatou Bensouda in a recent policy document that contains a new and welcome focus on the prosecution of individuals for human atrocities that are committed by destroying the environment in which we live and on which we depend. The document doesn’t change the law applied by the court. There is no new crime of ecocide for instance. Instead, it sets out the types of cases that the court will now select and prioritise for prosecution. These will include the illegal exploitation of natural resources, cases of environmental destruction, and “land grabbing”, where investors buy up vast areas of poor countries. While the court’s new policy is welcome, it is not a silver bullet. People convicted may be responsible for causing harm to thousands of victims and irreparable environmental damage. ICC Office of Prosecutor: Policy Paper on Case Selection & Prioritization:
[7] The Office will also seek to cooperate and provide assistance to States, upon request, with respect to conduct which constitutes a serious crime under national law, such as the illegal exploitation of natural resources, arms trafficking, human trafficking, terrorism, financial crimes, land grabbing or the destruction of the environment. … [10] Finally, the Office recalls that it fully endorses the role that can be played by truth seeking mechanisms, reparations programs, institutional reform and traditional justice mechanisms as part of a broader comprehensive strategy. … [41] In this context, the Office will give particular consideration to prosecuting Rome Statute crimes that are committed by means of, or that result in, inter alia, the destruction of the environment, the illegal exploitation of natural resources or the illegal dispossession of land. … [51] The Office will also take into consideration the following operational case prioritisation criteria, to ensure that the Office focuses on cases in which it appears that it can conduct an effective and successful investigation leading to a prosecution with a reasonable prospect of conviction. Although these considerations will typically arise in all of the Office’s activities and routinely require the adoption of measures to mitigate and manage their effect, the criteria below will be used to assess operational viability in a relative manner across selected cases: (a) the quantity and quality of the incriminating and exonerating evidence already in the possession of the Office, as well as the availability of additional evidence and any risks to its degradation; .. The World Needs a Water Treaty:
During the face-off earlier this year between India and Pakistan over a terrorist attack that killed more than 40 Indian paramilitaries in Kashmir, New Delhi made an existential threat to Islamabad. The weapon was not India’s considerable nuclear arsenal, but one still capable of inflicting ruinous destruction: water. “Our government has decided to stop our share of water which used to flow to Pakistan,” said Indian Transport Minister Nitin Gadkarikin on February 21. “We will divert water from eastern rivers and supply it to our people in Jammu and Kashmir and Punjab.” India controls three major rivers that flow into Pakistan. If India had followed through, it would have abrogated the 1960 Indus Water Treaty (IWT) between the two counties, a move that could be considered an act of war. There is no such thing as a local or regional solution to the water crisis, since the problem is global. The only really global organization that exists is the United Nations, which will need to take the initiative to create a worldwide water agreement. If countries don’t come together around the conventions — which need to be greatly strengthened — and it becomes a free for all with a few countries holding most of the cards, sooner or later the “water crisis” will turn into an old-fashioned war. – Foreign Policy in Focus: The World Needs a Water Treaty.

Yeo Bee Yin: World Needs Global Waste Footprint Treaty.
That same month, Malaysia announced that it was temporarily banning the import of plastic scrap. Thailand and Vietnam made similar announcements around that time. Yeo’s office vowed to root out illicit recyclers from the country. In the intervening months, her ministry has shut down more than 130 illegal plastic waste recycling facilities, several of which have been charged in court and slapped with significant fines. Yeo said the ban will eventually be lifted. New, permanent regulations are expected to roll out in the coming months. These are meant to include limitations to the amount of contaminated plastic scrap that will be allowed into the country, Yeo said, as well as more stringent rules regarding recycling permits. The minister has also been advocating for an international treaty that would make the global movement of plastic scrap more transparent and equitable. “The citizens of the developed world need to demand that their governments be transparent about the way they track their waste. Where exactly is your trash going? Where is your plastic going?” she said. “[What] irritates me is the injustice. The injustice seeing people in the developing world suffering from the rubbish [originating] in developed countries.” Greenpeace’s Heng said he was heartened by the minister’s enthusiasm. We see this as a positive step forward,” he said. “The government is highlighting how broken the international recycling system is.
