RI-SoS: RR: There are currently no filing requirements for write-in candidates in Rhode Island. In order for a vote to count for a write-in candidate, a voter must write the name of the candidate on the “Write-in” line and fill in the oval to the left of the name.

McV/EoP: LJ: Any and all ‘McVeigh 2020 write in votes’ will be counted by Rhode Island elections officials. ‘McVeigh Write In vote’ means: where a voter writes in the first and last name of McVeigh 2020 – Timothy James McVeigh – candidate, or a misspelled reasonable combination of the candidate’s name; on the “Write-in” line and fills in the oval to the left of the name.  Correct. The Board of Elections oversees this process and can answer questions on this topic.

RI-SoS: RR: There may be however, legislation introduced that would require write-in candidates to file a statement with the Secretary of State’s office by the Friday before the election indicating the candidate’s desire to be a write-in candidate. Please check back in July for a status update.

McV/EoP: LJ: The ‘Friday before the election .. please check back in July for a status update’ is a little confusing. The Rhode Island General Assembly meets every January – June. It will not be until the end of June that we will know if the legislation passes.

[A] If ‘check back in July’ was a reference to another Rhode Island election to be held in July / August? Our statewide primary is in September but it does not include the presidential candidates.

The McVeigh filing was not about any July / August Rhode Island election, but about the November 03/04 US Presidential election held in all 50 US States and US territories. Understood but should the write-in legislation pass, it may be in effect for the November election in which case you’d have to file with our office.

[B] If ‘check back in July’ is the final date whereby Rhode Island elections officials will decide their write in candidate rules, for the 03/04 US Presidential elections? Yes. We will know by then whether or not the legislation (if introduced) has passed.

If so:

[B1] If there are no Rhode Island write in candidate for 03 November US Presidential elections rules changes by July, then all McVeigh 2020 write in votes by registered Rhode Island voters will be counted, by Rhode Island elections officials. Correct. The Board of Elections oversees this process and can answer questions on this topic.

[B2]  If there are Rhode Island write in candidate rules changes by July, and McVeigh 2020 candidate (a) meets such rules requirements, McVeigh 2020 write in votes by registered Rhode Island voters will be counted, by Rhode Island elections officials; (b) does not meet such rules requirements, McVeigh 2020 write in votes by registered Rhode Island voters will not be counted, by Rhode Island elections officials. Correct. The Board of Elections oversees this process and can answer questions on this topic.
