I am able to send the crashed drive in for analysis, to enable you to understand the scope of the work that is required before a quote can be issued. The hard drive was removed by computer repair technician, after the computer crashed – mechanical, electrical or virus cause unknown, but the technician said he thought the data would be able to be retrieved – a few years ago, and is in my storage possession.

The legal application has not yet been filed, if there is no out of court resolution within the next few days, it will be filed by end of week.

There is only one way that the respondents estate executor / counsel can confirm that the document was physically provided to the respondent [19 Mar: LJ Re TOFS-IR Re: Barter Exchange Agreement with GM Elliott: All EoP MILED Clerk verbal / written correspondence taped by FSB / NSA]. Once the affidavits are filed authorizing the NSA/FSB to release the information, they may or may not choose to do so.

There are two ways in which the respondents estate executor counsel can confirm that the legal documents exist and were authored for delivery to the respondent, and are on the crashed hard drive: (a) FSB / NSA tapes proving such; (b) Data recovery from hard drive.

As of date the respondents estate executor / counsel has not clarified the detailed issues in dispute; regarding what exactly the facts in dispute are with regard to the documents, and submission of documents to the respondent; ie. whether they dispute (a) the documents existence and were authored and are on the crashed hard drive; and/or (b) don’t dispute the documents existence, dispute that the documents were physically submitted to the respondent.

Current financial reality does not provide for me to be able to afford retrieval of the data; but if current separate pending court disputes are resolved in my favour, then I may have the financial means to afford the data retrieval.

Once they clarify the issues in dispute, it will be clearer as to what road to take.
