LJ: Is this the George Service Point office for the Capetown office of Master of the High Court.

DP: Yes it is.

LJ: I want to file a document into a Capetown Master of the High Court Estate Case File.

DP: Do you want to contest a will. If so: then you don’t file the document with our office. We are neutral. Then you have to file an application with the High Court Registrar to contest the will and we abide by the High Court ruling.

LJ: The deceased was my friend, landlord and employer. I have been unlawfully dismissed and evicted by Ms Isobel Rohwer, in her capacity as Executor of the Estate, but who has not provided me with any documentation confirming herself as the Executor of the Estate. Also, her Executor of Estate dismissal/eviction is in violation of my labour/lease barter exchange agreement with the deceased. I intend to file an unlawful dismissal/eviction application with the CCMA. In my CCMA application I want to document that I have informed the Master of the High Court, of the contents of the attached Affidavit statement, requesting the Master of the High Court call a meeting of the written will heirs. I intend to file a copy of this document in the CCMA unlawful dismissal/eviction filing.

DP: What is the Estate file case number and what is the amount of the estate?

LJ: The Estate case number is on the top of that application document. I don’t know what the amount of the estate is. I have not seen a copy of the will. As far as I am aware the property was part of the estate, and I don’t know if there were additional assets, and if so their amount. The property is probably about R2 million or thereabouts.

DP [Looks up the case number on the front page of the Application document. Types in the number and information into the computer]

DP: It was filed in Capetown Master of High Court Office. The estate is currently appraised for the amount of R2.7 million. As of date nobody has been appointed by the Master of the High Court as the Executor of the Estate of Gill Elliott. A Ms Isobel Rohwer applied for the position of Executor of the Estate; but the computer indicates that she has not yet been appointed by the Master of the High Court, as the Executor of the Estate. Perhaps Ms Rohwer has not filed the security amount required; or perhaps the Master of the High Court did not consider her to be professionally legally qualified enough to be appointed as the Executor.

DP: [Accepts documents for filing and stamping]

LJ: [Notices copying error]

LJ: Do you have a printer where I can make a copy of the original. I made copies of the unsigned original; instead of the signed original.

DP: Sorry, the printer is not working.

LJ: Okay, I will quickly have to go back and make copies of the signed original.

DP: Okay, but you better be quick, cause the courier is coming soon, then I have to put the documents in the pouch to be couriered to the Master of the High Court office in Capetown.

LJ: [Goes to Postnet to make copies of the signed original. Returns to the Magistrates Court Office]

DP: [Stamps original and copy. LJ accepts original. Copy of original is filed in courier pouch]
