MLI-EB 01:  We received various settlement proposals and pieces of correspondence from you, and replied to these as our clients saw fit.

EoP-LJ 01: I don’t know who the decision-makers are between you and your clients. Francois Lamprecht’s correspondence clearly stated that his decisions were on the instructions of his clients; currently your clients. That clarity has not been forthcoming in your correspondence, on behalf of your clients.

Your clients were/are not obliged to accept my settlement agreement offers.

Marais Law Inc was/is not obliged to accept my settlement agreement offer.

MLI-EB 02: There was no agreement to suspend proceedings and, in the absence of such an agreement, the time periods prescribed by the Rules of Court apply.

EoP-LJ 02: To the extent that neither you nor your clients objected to; or declined my offer to suspend the application proceedings; there was a lack of clarity from yourselves; as to whether you accepted the offer or not.

MLI-EB 03: If you simply proceed to deliver a replying affidavit, our clients will object thereto as being out of time and an irregular step.

EoP-LJ 03: As previously stated, they are welcome to do so. The Magistrate is welcome to consider their arguments for their objection; and if accepted to ignore the contents of my replying affidavit. The Magistrate is also welcome to ignore your arguments and enquire into the evidence submitted in my replying affidavit.

MLI-EB 04: We note that you enrolled the matter for a public holiday.

EoP-LJ 04: I was not aware of that. Thanks for the info. I shall have to ask the clerk what the procedure is in the case of such an error, whether it is postponed for a later date.

Do you have a preference for any particular date, that I can request the clerk to postpone it to?

MLI-EB 05: This is the last time we shall reply to correspondence from you that contains expletives.

EoP-LJ 05: That is the first time Marais Law Inc has received correspondence from me that contained expletives.

MLI-EB 06: For the avoidance of any doubt, the executrix rejects your claim for delivery of the Alsation dog (Roy) on the basis that no evidence exists that the dog was gifted to you by the deceased. Under the circumstances the executrix cannot accept your claim.

EoP-LJ 06: Noted. The Executor has made a S33 Rejected Claim decision ignoring the affidavit evidence submitted to her, and refusing to make a S32 Disputed claims enquiry, to enable her to make a fully informed truthseeking enquiry; prior to making her S33 Rejected Claims decision.

MLI-EB 08: Our clients are willing to settle the matter on the basis that you withdraw the application and tender to pay their costs.

EoP-LJ 08: If your clients are able to clarify one question that any of your clients have asked that I have refused to provide a sincere ego literate voluntary cooperative active listening / reading transparent written answer to, I shall happily pay their costs as follows: provide them with a sincere written apology for my delay in answering the particular question; and denying them access to the particular information requested from me.
