If after having perused the S 36 Notice [23 Apr: LJ: S36 Admin Estates Act Ntc: Re: GMC 542-21 / MHC 4968-20 / CCMA: 1279-20]; the Executor’s decision is:

[A] To Consent to the S36 Notice; with a S35 decision [Liquidation and Distribution Accounts]

The matter can be postponed to 8 June or earlier if so preferred. If earlier: as soon as the S35 decision settlement agreement paperwork is completed; for the settlement agreement to be made an order of court.

[B] To Consent to the S36 Notice; with a S32 decision [Disputed Claims]

The matter can be postponed to 08 June or earlier if so preferred. If earlier: as soon as the S32 Disputed Claims enquiry has been held, and applicant and respondents have made their fully informed concede S 35 settlement agreement; or S33 oppose decisions, based on the information disclosed from such S32 disputed claims hearing.

[C] To Oppose the S36 Notice; with a S33 decision [Rejected Claims]

If so, the matter is probably best placed on the Opposed Motion Roll sooner than later – no point in wasting a month waiting for the Executor’s S32 or S35 decision; if she has no intention of making such a decision – for the Magistrate to decide whether to order the Executor to initiate a S32 Disputed claims hearing; and/or to refer the perjury claim to the Police; and/or to make some other decision she considers appropriate.

Soon as the Executor has some idea of what her decision is going to be; we can proceed with the postponement of case enrollment date; to a mutually agreeable ‘settlement agreement made order of court’ date; or to ‘opposed motion roll’ date; in accordance with her decision.
