Re: 542/21: Magistrate Meeting / Case Enrollment Date.

I received Marais Law Inc email from Elizma Barnard sent 30 Apr 2021 [30 Apr: MLI-CM: 542/21: Re Magistrate Case Enrollment Meeting]

MLI-CM: When we called at the Magistrate’s Court to make an appointment with the Magistrate to meet with her in order that she could allocate a date for the hearing of this matter, the Magistrate informed us that we could either meet with her, alternatively she indicated that 25 May 2021 (at 14h00) or 28 May 2021 (at 09h00) are still available for the enrolment of this matter. Kindly urgently advise whether either 25 or 28 May 2021 will suit you to argue this matter before the Magistrate in Court.  If neither of these dates will suit you, we will advise you of a date and time at which we can meet with the Magistrate for her to allocate an alternative date for the hearing. We look forward to hearing from you urgently.

EoP-LJ: As of date I have not received any response from your client: first respondent: Executor of Elliott Estate: Marlise Steenekamp to S36 Notice filing submitted to her on 23 April 2021 [23 Apr: LJ Re: 542/21: Re Case Enrollment / Opposed Motion Roll Date].

As previously noted to Mr Marais, if he wants a meeting with the Magistrate, that is fine. Alternatively if Mr Marais would prefer to make his clients argument in court; he can do so.

As per Mr Marais request for consent for a court date: In a choice between 25 May at 14h00 or 28 May at 09h00. I prefer 25 May 2021.

If Mr Marais wants to argue his clients argument before the Magistrate in a meeting; or in court. He is welcome to do so.

I will not be arguing any matter before the Magistrate in any meeting or in court. I shall simply request the Magistrate to confirm the accuracy of the documents filed into the court file, and if accurate; to confirm that she has read the court record file, prior to making any ruling. Once she has read the file and has any questions; I shall answer her questions; to enable her to make a fully informed decision, as to her ruling, with regards to my submissions.
