MLI-CM: As you will have noted from the Notice of Set Down sent to you earlier, this matter will be heard on 25 May 2021.

EoP-LJ: As per EoP-LJ 30 April 2021 13:57 email [30 Apr: LJ Re: MLI-EB: Re: 542/21: Magistrate Meeting / Case Enrollment Date].


MLI-CM: In the ordinary course of business the applicant (in other words you) must index and paginate the court file.

EoP-LJ: The ordinary course of EoP law dispute resolution is different; however thanks for the information.

If the Magistrate and/or a respondent and/or their counsel had requested me to index and paginate the court file, I would have done so.

Presumably your boss wanted you to do it, for some or other reason. Perhaps one day he will disclose his reasons.


MLI-CM: As this has not yet been done and the Magistrate commented on this, we have taken the liberty of doing the necessary and attach hereto a copy of the court file index.

EoP-LJ: I have received no correspondence from the Magistrate, on any issue whatsoever.

In the past twenty years of court cases in South Africa; I have refused to enter into correspondence with any Magistrate behind the Respondent and/or Prosecutors backs.

As far as I am aware – although I could be wrong – an index of the court record file is done for the final hearing; not for the court enrolment date.


MLI-CM: If you are unsure about any of the documents referred to in the index, please do not hesitate to contact us.

EoP-LJ: From brief perusal: the documents numbered 01 to 94 appear to be correct.

I did receive copies of documents 97 to 99.

Re Doc 95:

I would imagine that Notice of Intention to Oppose and First and Second Respondents Opposing Affidavits [Doc 28, 29, 30, 31 & 32] were served on Third and Fourth Respondents at the same time as they were on Applicant on 11 March 2021.

Why Marais Law Inc served First and Second Respondents Notice to Oppose documents on third and fourth respondents again on 10 May 2021, two months after they were served on applicant; is unclear.

Re Doc 96:

I did not receive a transparency copy of document 96, from fourth respondent.
