Politico: Joe Biden’s transition team has tried to project calm as President Donald Trump refuses to concede and many Republicans — and even one key part of the federal government — continue to have his back. But behind the scenes, Biden’s advisers are in the midst of a fierce lobbying blitz to get Trump’s allies to crack. They’re dispatching emissaries from past administrations — Republican and Democrat — along with a wide array of business and interest group leaders to intercede on Biden’s behalf. According to three transition officials, Biden’s team is in talks with multiple Republican leaders and officeholders to end the transition stalemate, warning them of risks to national security and public health if the president-elect isn’t granted access to the government. Biden and Vice President-elect Kamala Harris are also deploying aides and allies to ramp up public pressure on General Services Administrator Emily Murphy, who has refused to acknowledge Biden’s victory and thus allow the transition to officially begin.  Democratic congressional leaders have joined in, too, criticizing Murphy for holding up the transition. “At some point, we have to recognize defiance for what it is. And that’s not tolerable. We had an election. Joe Biden won — not, not even close — it’s a decisive win,” said Rep. Gerry Connolly, chair of a key House Oversight subcommittee who has written to Murphy. “I worry about precedent. If this isn’t challenged and dissipated quickly — the denial part here — it becomes a new tactic in dragging out an election and clouding the results in the minds of lots of … voters. And that is dangerous in a democracy.” Biden’s team is trying to walk a line between blasting Murphy and Republicans — which might cause them to dig in more — and highlighting what they call legitimate dangers of delay. They want to avoid open partisan warfare, convinced it would only further inflame Trump and his supporters. To further highlight the issue, Biden this week met with outside national security experts in Wilmington, Del. to discuss their experiences battling coronavirus. And while Harris received a classified intelligence briefing in her capacity as a senator, Biden noted he is not entitled to such classified briefings until the GSA acts. The GSA’s refusal to acknowledge Biden’s election victory is also blocking access to millions of dollars in government resources that would cover an array of costs, such as staff, travel, experts and consultants. It would also enable the Biden team to freely contact government officials including Fauci. CNN: A handful of current Trump administration officials, as well as some political appointees who left in recent months, have quietly started to reach out to members of President-elect Joe Biden’s transition team, according to people briefed on the matter. The outreach is a sign that President Donald Trump’s refusal to concede the election and the continued obstruction from the White House is beginning to frustrate even those affiliated with the administration. CNN they’re viewing the outreach effort as putting duty to the country over partisan considerations. The conversations are not as detailed as formal briefings that would take place under the officially sanctioned transition, sources said, but they at least could help incoming Biden transition members have a sense of the issues they might have to deal with upon taking office. Another former White House official who left the administration a few months ago said that he personally emailed someone who he expects will be back in the Biden administration in a similar role to his and offered to help. One current administration official confirmed to CNN on Wednesday that there has been informal outreach from inside Trump’s government to Biden’s team. “Nothing that would get us in trouble,” the official said. “Just an offer to be of help. They know what we mean, and what we can-and-can’t do or say.” The official said that outreach thus far hasn’t resulted in any substantive conversations. A senior adviser to Biden acknowledged the outreach from across the government, but declined to comment. Fox News: The decision by U.S. Middle District Judge Matthew Brann on Saturday was just the latest disappointment for the Trump 2020 Campaign, which was struggling to overturn the results of the Nov. 3 election.  U.S. Sen. Pat Toomey, R-Pa., threw his support behind Judge Brann’s decision Saturday, and congratulated Biden and Vice President-elect Kamala Harris for their victory. Politico: ‘WE DON’T NEGOTIATE WITH TERRORISTS’ — Some in the Biden camp warn that the left wing of the Democratic Party is already spoiling the goodwill they built up during the presidential campaign with the flurry of attacks this week on President-elect JOE BIDEN’s early White House appointments. “I think we are at a fork in the road,” said one Democratic operative in close touch with the Biden campaign. “They can either continue to just beat the drums on the streets or they can start to leverage the relationship they have. It’s up to them which strategy they adopt.” The left wing’s publicly aggressive tactics could lead Biden to just tune them out altogether. “If all you do is escalate, then people eventually think that you’re enemies and not friends and they’re like: ‘We don’t negotiate with terrorists,’” said JESS MORALES ROCKETTO, a Democratic strategist who supports many of the left wing’s goals. The chill in the relationship comes after a number of progressive groups and politicians made clear this week that there would not be any honeymoon period for the new Democratic administration. The climate-focused group Sunrise Movement accused Biden this week of “betrayal” for hiring longtime ally Rep. CEDRIC RICHMOND (D-La.) because the fossil fuel industry has been a longtime backer. Justice Democrats bashed Biden for his “corporate-friendly” appointments, including his new senior counselor STEVE RICCHETTI. It is hard to think of an American film that provoked a greater backlash in 2020 than “Planet of the Humans.” Focused on the theme of planetary extinction and fanciful proposals to ward it off, the documentary was released for free on YouTube on April 21. The date was significant not only because it was the eve of the 50th anniversary of Earth Day, but because a global pandemic was tearing through America’s social fabric and exposing the human toll of the country’s globalized, growth-obsessed economic model. Even before “Planet of the Humans” was released, however, the producers of the film had fallen under pressure to retract it. Upon the film’s release, a who’s who of self-styled climate justice activists proceeded to blanket the internet with accusations that it was a racist, “eco-fascist” screed that deliberately advanced the interests of the oil and gas industry. When “Planet of the Humans” was briefly yanked from YouTube thanks to a questionable copyright claim by an angry climate warrior, the free speech organization Pen America issued a remarkable statement characterizing the demands for retraction as a coordinated censorship campaign. What had this documentary done to inflame so much opposition from the faces and voices of professional climate justice activism? First, it probed the well-established shortcomings of renewable energy sources like solar and wind power that have been marketed as a green panacea. “Planet of the Humans” portrayed these technologies as anything but green, surveying the environmental damage already caused by solar and wind farms, which require heavy mining and smelting to produce, destroy swaths of pristine land, and sometimes demand natural gas to operate. While major environmental outfits have lobbied for a Green New Deal to fuel a renewables-based industrial revolution, and are now banking on a Democratic presidency to enact their proposals, “Planet of the Humans” put forward a radical critique that called their entire agenda into question. As the director of the documentary, Jeff Gibbs, explained, “When we focus on climate change only as the thing destroying the planet and we demand solutions, we get used by forces of capitalism who want to continue to sell us the disastrous illusion that we can mine and smelt and industrialize our way out of this extinction event. And again, behind the scenes, much of what we’re doing to ‘save’ the planet is to burn the ‘bio’ of the planet as green energy.” “Planet of the Humans” crossed another bright green line by taking aim at the self-proclaimed climate justice activists themselves, painting them as opportunists who had been willingly co-opted by predatory capitalists. The filmmakers highlighted the role of family foundations like the Rockefeller Brothers Fund in cultivating a class of professional activists that tend toward greenwashing partnerships with Wall Street and the Democratic Party to coalitions with anti-capitalist militants and anti-war groups. ………..  In the weeks ahead of the Democratic National Convention, climate justice organizations like the Sunrise Movement 501 c-4 which emerged in the shadow of Sen. Bernie Sanders’ presidential run and condemned former Vice President Joseph Biden as a tool of the establishment suddenly changed their tune. Flush with dark money from Democratic Party-aligned billionaires, Sunrise Movement co-founder Varshini Prakash stated on July 14 – the day Biden released his clean energy plan: “It’s no secret that we’ve been critical of Vice President’s Biden’s plans and commitments in the past. Today, he’s responded to many of those criticisms: dramatically increasing the scale and urgency of investments… Our movement, alongside environmental justice communities and frontline workers, has taught Joe Biden to talk the talk.” While it brands itself as a grassroots movement that has organized anti-establishment stunts putting centrist figures like Democratic Sen. Dianne Feinstein on the spot, the Sunrise Movement was incubated with a grant from the Sierra Club, the Mike Bloomberg-backed juggernaut of Big Green organizing. Today, offices of the two organizations are located a floor apart in the same building in downtown Washington DC. Ahead of the DNC, the Biden campaign introduced a $2 trillion plan pledge to invest heavily in renewable technology to achieve “a carbon pollution-free power sector by 2035.” The plan promised to erect 500 million solar panels in the next five years alongside 60,000 new wind turbines. With the demand for solar plummeting due to the coronavirus pandemic, the prospect of gigantic government subsidies was music to the ears of the “cleantech” tycoons who sponsor Democratic Party-aligned climate advocacy organizations. Many of these green millionaires and billionaires had feasted at the trough of Obama’s stimulus package, which was directly responsible for powering the rise of America’s solar industry. After promising upon his inauguration to invest $150 billion in “a new green energy business sector,” Obama doled out an eye-popping $4.9 billion in subsidies to Tesla’s Elon Musk and a $1.2 billion loan guarantee for Tom Dinwoodie’s SunPower US to construct the California Valley Solar Ranch. In June 2019, an “avian incident” caused a fire at the SunPower Solar Ranch project, impacting over 1200 acres and knocking out 84% of generating capacity for several weeks. “Planet of the Humans” presented viewers with the disturbing story of the Ivanpah solar plant, a signature initiative in Obama’s green energy plan which was co-owned by Google. Gifted with $1.6 billion in loan guarantees and $600 million in federal tax credits, Ivanpah was built on 5.6 square miles of pristine public land close to California’s Mojave National Preserve. In its first year, the massive plant produced less than half its of its planned energy goal while burning over 6000 birds to death. Because of the intermittency inherent to solar power, the gargantuan energy project has had to burn massive amounts of natural gas to keep the system primed when the sun is not shining. Despite its dependence on fossil fuel, Ivanpah still qualifies under state rules as a renewable plant. “The bottom line is the public didn’t expect this project to consume this much natural gas,” David Lamfrom, California desert manager for the National Parks Conservation Association, told the local Press-Enterprise. “We did not have full knowledge that this was what we were signing up for.” Even after the Obama administration poured billions of dollars into solar projects, solar energy output increased between 2008 and 2016 by just .88% as a total of American energy production. Meanwhile, across the country, many new wind projects remain stalled due to community concerns about land destruction. In the home state of Green New Deal advocate Sen. Bernie Sanders, the only remaining wind project was canceled this January. For raising questions about the efficacy and environmental cost of renewable projects like these, and proposing an explicitly anti-capitalist solution to the corporate destruction of the planet, the makers of “Planet of the Humans” were steamrolled by a network of professional climate activists, billionaire investors and industry insiders. Now, with the Biden campaign promising a new flood of renewable subsidies and tax breaks under the auspices of a “clean” energy plan, the public remains in the dark about what it is signing up for. The problem with dissent is that there’s a time and place for it, and there’s a time and place not to have it. I tell people, “When the landing-craft ramp drops and hits the beach, that’s not the time to discuss the plan.” Unhealthy dissent goes away when you show your team respect, engage them in the process and pass information along to them. Give them as much transparency into decision making as is possible and practical to do. But everybody needs to understand that there’s a point–once a decision has been made or a line has been crossed–at which dissent is no longer appropriate, unless it is very carefully and very maturely provided in the right time, place and way. And that takes a deft hand. What I’m saying is that it’s not okay to bitch about everything all the time and fight things. War on the Rocks: Professor and historian Francine Hirsch of the University of Wisconsin-Madison seeks to set the record straight in a wonderful new book, Soviet Judgment at Nuremberg: A New History of the International Military Tribunal After World War II. Drawing upon original research from newly available and under-studied Soviet archives, Hirsch offers a rich narrative account of the convening, proceedings, and aftermath of the Nuremberg Tribunal that challenges several of the central myths that many, myself included, have accepted. Most importantly, the book surfaces the foundational role played by Soviet jurists in the convocation of the first truly international war crimes tribunal and the inauguration of the international criminal law canon. Although focused on the so-called “trial to end all wars,” the book also covers the inauguration of the Cold War through the vehicle of a courtroom drama. Hirsch reveals that the Nuremberg trial was, in many respects, “the last hurrah of wartime cooperation for the Allied powers” and “an early front of the Cold War.” This is not mere hindsight. Rather, these seismic geopolitical shifts were palpable to all involved in the trial. Indeed, they prompted Hermann Göring — arguably the highest-ranking defendant tried at Nuremberg — to quip that, “the only allies who are still allied are the four prosecutors, and they are only allied against the defendants.” In other words, it was apparent to all that by the time of the trial, the allies were no longer allied, except in their desire to convict the defendants. .. A Russian Jew and legal contemporary of Raphael Lemkin (who coined the term ’genocide’) and Hersch Lauterpacht, Aron Trainin is credited with pushing for the establishment of an international court following the war in his academic writing and well before the allies were on board with the idea, introducing the concept of crimes against the peace (or ‘crime of aggression’ in today’s lexicon), and advocating for the creation of a permanent international criminal court to try future war criminals.
